Refugee Protection

Any port of entry into Canada, whether it be a seaport, an airport, or a land border crossing, is a place where you can apply for refugee protection if you need protection or are a convention refugee. Moreover, claims may be submitted from within Canada. You can include family members in your application.

Who qualifies as a Convention refugee or a person in need of protection is determined by the Immigration and Refugee Board of Canada (IRB).

Convention refugees reside outside of the country in which they were born or the country that they normally reside in. They are not able to return home because of “a well-founded fear of persecution” based on race, religion, political opinion, nationality, membership in a social group (such as women or persons with a specific sexual orientation).

A person in Canada who is unable to safely re-enter their native country is considered to be in need of protection. Because they could face “danger of torture, risk to their life or risk of cruel and unusual treatment or punishment”.
